There's a lot of grey area, especially when the nature of the crime being committed is so egregious that we can't help but be shocked and horrified at it. But when in doubt, the Bible prevails and that would be whose Point of View we're following in the movie. If we're tagging along with the cops, mostly, it's a crime movie. If we're hanging with the intended victims mostly, then it's horror.



The only reason genres should exist is for categorization. If you look at a picture like Fincher's Seven, they can coexist rather well. At their most basic, a horror is about horrifying the audience and a crime procedural is about unraveling a plot or tracking down an antagonist. There are no glaring conflicts here. The entire Saw franchise is another testament to this.
